Allahabad High Court: PNB work experience cannot be considered government experience, candidate's petition dismissed

In a significant ruling, the Allahabad High Court has clarified that work experience gained at Punjab National Bank (PNB) cannot be equated with experience in a government office. By dismissing a candidate's petition, the court emphasized that strict adherence to the experience criteria specified in recruitment advertisements is mandatory. This decision provides a clear directive regarding the validity of experience certificates in various government recruitment processes.

The Allahabad High Court recently settled a legal dispute by clarifying that experience in the banking sector is not equivalent to experience in a government office. The court dismissed a petition filed by a candidate employed at Punjab National Bank, who had sought to have his banking experience recognized as government service experience.

According to reports from the Amar Ujala network, the case centered on the specific conditions outlined in a recruitment advertisement. The candidate had argued that his tenure at PNB should be counted as government experience to satisfy the eligibility criteria for the position.

The court refused to accept this contention. The judge noted that the experience requirements stipulated in recruitment advertisements are highly specific and cannot be interpreted broadly. Experience within a bank does not fall under the definition of experience in a government office.

This ruling serves as a caution to candidates who attempt to interpret the conditions of recruitment advertisements to suit their own circumstances. The court clarified that the validity of an experience certificate depends entirely on the criteria mentioned in the advertisement.

In its order, the court stated that the operational procedures and service conditions of government offices and public sector banks are distinct. Therefore, it is legally inappropriate to categorize experience from both sectors in the same manner.

Following the dismissal of the petition, the candidate is no longer eligible to participate in the recruitment process. This decision is a step toward ensuring transparency and strict adherence to rules in recruitment examinations.

Legal experts believe that this judgment will serve as a precedent for future recruitments. Candidates will now need to carefully examine experience requirements before submitting their applications.
