Court restricts hookah services in UP restaurants, citing risks to minors

The court has taken a firm stance against hookah bars in Uttar Pradesh, ruling that restaurants cannot serve hookah under the guise of dining. Emphasizing that designated smoking zones are limited exceptions to public smoking bans, the court warned that allowing such services in restaurants poses a significant risk of misuse by minors.

The court has issued a significant observation regarding the operation of hookah bars in Uttar Pradesh. According to reports from the Amar Ujala network, the court clarified that providing hookah services within restaurants or commercial establishments is against the law. The court emphasized that offering such facilities under the pretext of a restaurant is not legally permissible.

In its order, the court referenced existing provisions regarding the prohibition of smoking in public places. The judicial observation noted that designated smoking zones were created only as limited exceptions. The purpose of these zones is to protect public health, not to facilitate businesses like hookah bars.

The court also expressed serious concern regarding the safety of minors. It noted that if hookah services are permitted in restaurants, there is a persistent fear that minors could misuse them. Such a situation could prove detrimental to society and the health of the youth.

The court clarified that the exception for smoking zones cannot be applied to hookah bars. This rule is intended only for specific circumstances defined by law. The operation of hookah bars does not fall within the scope of these regulations.

According to the Amar Ujala report, this decision was taken with the aim of prioritizing public health and safety. Instructions have been given to the administration to remain vigilant in this regard to ensure that the rules are not violated.

The court's stance makes it clear that public health cannot be compromised for commercial gain. Restricting the operation of hookah bars will help in protecting the youth from the habit of smoking.

In the coming days, relevant departments may take action to ensure compliance with this order. This step is considered a significant effort toward making smoking control laws more effective in the state.
