Bankers' Books Evidence Act 2026: New legal framework for banking records to be effective from October 1

The central government has announced that the Bankers' Books Evidence Act, 2026, will come into effect on October 1, 2026. This new law will replace the 1891 Act and recognize banking records in digital, cloud, and other modern formats as evidence. The objective is to modernize the banking system and promote ease of doing business.

Taking a significant step toward reforming the banking sector, the central government has issued a notification to implement the 'Bankers' Books Evidence Act, 2026'. This law will be effective across the country starting October 1, 2026. The new act received presidential assent on August 13, 2026, and will replace the archaic 1891 law.

The primary objective of this law is to modernize and simplify the process of presenting banking records as evidence in legal proceedings. Given the advancements in banking technology, this act adopts a technology-neutral approach. Under this, along with physical documents, electronic, digital, virtual, and cloud-based banking records have been granted legal recognition.

The process of certifying banking records under the act has also been standardized. Now, digital or electronic signatures can be used to certify records, which will facilitate ease of documentation. This reform is part of the government's commitment to strengthening the legal framework in line with the changing needs of the economy.

The law also brings clarity regarding summoning bank officials to court proceedings. If a bank is not a party to a legal case, the court must record 'special reasons' in writing to summon bank officials. This provision will help reduce the unnecessary workload on bank staff.

Furthermore, the central government will have the authority to extend these provisions to other specified entities in the financial sector. This will make it easier to align with the changing financial landscape in the future. This move is a significant part of the government's efforts to promote 'Ease of Doing Business'.

According to the Ministry of Finance, this law has been introduced to strengthen a modern and efficient financial system. It will not only simplify the management of banking records but also bring transparency and speed to judicial processes.
