Bombay High Court reprimands Maharashtra FDA, forces withdrawal of arbitrary orders

The Bombay High Court has strongly criticized the Maharashtra Food and Drug Administration (FDA) for violating the principles of natural justice. According to an NDTV India report, following the court's displeasure, the FDA was forced to withdraw its orders to cancel Cipla's license and suspend the operations of a restaurant at the MCA premises. The court also posed sharp questions to the FDA regarding its conduct.

The Bombay High Court has raised serious questions regarding the operational methods of the Maharashtra Food and Drug Administration (FDA). The court reprimanded the FDA for disregarding the principles of natural justice and issuing arbitrary orders in a hasty manner.

The matter surfaced when the FDA issued orders to cancel the license of Cipla and suspend the operations of a restaurant located at the MCA premises. Following the court's stern remarks, the FDA was compelled to withdraw these controversial orders.

During the hearing, the Bombay High Court asked FDA officials in a sharp tone whether they considered themselves to be God. The court expressed its displeasure over how such harsh measures could be taken without following due process and ignoring the fundamental principles of natural justice.

The court stated that administrative bodies must exercise their powers with responsibility and transparency. Decisions taken in an arbitrary manner not only infringe upon the rights of the affected parties but also raise questions about the credibility of the legal process.

According to the report by NDTV India, these decisions taken by the FDA had sparked significant controversy. The court found the actions taken against a major company like Cipla and the restaurant at the MCA premises to be unjustified.

Following this incident, the FDA has been directed to improve its functioning and strictly adhere to legal procedures before issuing any orders in the future. This reprimand from the court is being viewed as a significant signal toward administrative reform.

This case serves as an example of how judicial intervention can curb arbitrariness. The Bombay High Court has made it clear that no one is above the law and that no government department will be permitted to misuse its powers.

It is now expected that the FDA will exercise greater caution in such matters in the future and will fully respect the principles of natural justice.
