Kanpur Consumer Commission Rules: Car Company Must Pay Damages After Airbag Failure

In a tragic road accident in Kanpur, the car owner's son lost his life when the vehicle's airbag failed to deploy. The Consumer Commission has found RNG Auto Mobiles liable for deficiency in service. The commission has ordered the company to pay the insurance amount of over six lakh rupees along with eight percent interest to the victim's family.

The Consumer Forum in Kanpur has delivered a significant verdict holding a car dealership responsible for negligence. The case pertains to a fatal road accident where the vehicle's airbag failed to open, resulting in the death of the car owner's son. Following the incident, the aggrieved family approached the consumer commission seeking justice.

Commission President Vinod Kumar, while presiding over the case, categorized the failure as a clear deficiency in service. He stated in his order that such lapses in safety standards constitute a direct violation of consumer rights. The presence of airbags is a mandatory safety feature, and their failure to deploy during a collision represents a serious technical malfunction.

The court has directed RNG Auto Mobiles Private Limited to pay an insurance claim amount of 636,794 rupees. This compensation is not limited to the principal amount; the company is also required to pay an additional eight percent interest on the total sum to the victim's family.

This ruling serves as a precedent for vehicle owners who rely on safety features when purchasing automobiles. The commission clarified that if companies are negligent regarding the quality or maintenance of safety equipment, they will be held accountable under the law.

The victim's family has expressed satisfaction with the verdict. While no amount of compensation can replace a lost life, the commission's firm stance is expected to compel companies to exercise greater caution in the future.
